OPINION. AUTHORITY. OUTCOME.

Expert Witness

Independent medical expert witness services for claimants and defendants — providing authoritative opinions on standard of care, causation, liability, and damages that courts can rely upon.

ABOUT THIS SERVICE

Medical Opinion That Shapes Legal Outcomes

In clinical negligence, personal injury, and related civil proceedings, the outcome often turns on the quality of the medical expert evidence. Courts require independent specialists who can evaluate complex clinical situations, form clear opinions on the standard of care provided, and explain their reasoning without advocacy.

Prof. Hindocha accepts instructions as a medical expert witness for both claimants and defendants. His work covers the full range of expert witness duties — from written reports addressing liability and causation through to prognosis, quantum of damages, and oral testimony at trial. Each instruction is handled with the rigour, objectivity, and procedural compliance that civil proceedings demand.

His background as a practicing consultant plastic surgeon gives his opinions a clinical authority grounded in current specialist practice. He is familiar with the courts' expectations of expert witnesses, and his reports consistently comply with CPR Part 35, the associated Practice Direction, and the GMC's guidance on acting as an expert.

AREAS OF EXPERT OPINION

Four Types of Medical Expert Evidence

Depending on the stage and nature of the proceedings, instructing parties may require one or several of the following types of expert medical opinion.

01

STANDARD OF CARE

Breach of Duty Assessment

Expert analysis of whether a practitioner's actions or omissions fell below the standard expected of a reasonably competent specialist in the relevant field — applying the Bolam and Bolitho tests to the clinical evidence.

02

CAUSATION & LIABILITY

Causation Opinion

Independent medical opinion on whether any identified breach of duty materially contributed to the injury or harm alleged. Addressing both factual and legal causation in a form the court can apply to determine liability.

03

DAMAGES ASSESSMENT

Nature & Extent of Harm

Detailed medical evaluation of the nature, severity, and duration of the injury or condition for the purposes of calculating general and special damages — including pain and suffering, loss of amenity, and care needs.

04

PROGNOSIS

Future Medical Needs

Assessment of the claimant's likely future medical trajectory — including further treatment requirements, ongoing care needs, expected recovery, and any permanent functional limitations — informing the quantum assessment.

THE ENGAGEMENT PROCESS

From Initial Instructions to Expert Opinion

STEP 1

Letter of Instruction

The instructing solicitor sets out the issues in dispute, provides the questions the expert is asked to address, and supplies the relevant case materials. Prof. Hindocha reviews the instruction and confirms whether the matter falls within his area of expertise.

STEP 2

Records & Case Review

All relevant medical records, clinical notes, imaging, and prior expert reports are reviewed in full. Prof. Hindocha considers the clinical evidence independently, identifying the key medical findings and assessing any limitations in the available material.

STEP 3

Expert Report

A comprehensive CPR Part 35-compliant report is produced addressing the questions posed — covering liability, causation, and where instructed, prognosis and quantum. The report is written to be accessible to judges, juries, and non-specialist legal professionals.

STEP 4

Trial & Settlement Support

Prof. Hindocha attends court or tribunal as required to give oral evidence. He can also attend joint expert meetings, provide supplementary reports or replies to questions under CPR Part 35.6, and advise at conference with counsel ahead of trial or settlement.

WHAT YOUR INSTRUCTIONS ACHIEVE

Informed Medical Opinion That Courts Can Act On

Prof. Hindocha's expert witness work gives legal teams the medical clarity they need to advise clients, negotiate settlements, and present compelling cases at trial. His opinions are formed independently and expressed with the precision that robust litigation requires.

  • Independent assessment of whether the standard of care met the Bolam / Bolitho test
  • Clear opinion on causation — whether any breach of duty materially contributed to the harm alleged
  • Assessment of the nature and extent of injury for damages and quantum purposes
  • Prognosis report including future medical needs, care requirements, and long-term outlook
  • CPR Part 35-compliant written report and oral testimony at trial, tribunal, or inquest

INSTRUCTED BY BOTH SIDES

Claimant & Defendant Work

Prof. Hindocha's primary duty is always to the court. He accepts instructions from both sides of a dispute — and his opinion does not change depending on who instructs him.

CLAIMANT INSTRUCTION

Acting for the Injured Party

When instructed by the claimant's legal team, Prof. Hindocha provides an independent assessment of the care received, the injuries sustained, and the impact on the claimant's life and future needs.

  • Standard of care assessment from the claimant's perspective
  • Causation opinion linking breach to harm
  • Prognosis and future care requirements
  • Damages evidence supporting quantum

DEFENDANT INSTRUCTION

Acting for the Defending Party

When instructed by the defence, Prof. Hindocha provides the same rigorous independent analysis — addressing whether the care given was reasonable and whether the alleged harm flows from any identified breach.

  • Defence-side standard of care opinion
  • Challenge to claimant's causation case where appropriate
  • Rebuttal or commentary on claimant's expert evidence
  • Alternative prognosis and damages assessment

WHY INSTRUCT PROF. HINDOCHA

The Credentials Behind Every Expert Opinion

Current Specialist Clinical Practice

Prof. Hindocha is a practicing consultant plastic surgeon with active clinical caseload. His expert opinions on standard of care are informed by current specialist practice — not historical knowledge — which gives his evidence authority in complex clinical negligence matters.

Equal Treatment of Both Sides

Prof. Hindocha accepts instructions from both claimants and defendants, including as a single joint expert (SJE). His primary duty is always to the court. Legal teams on either side can instruct him with confidence that his opinion is formed independently of the preferred outcome.

Procedurally Compliant Reports

Every report complies with CPR Part 35, the relevant Practice Direction, and the Protocol for the Instruction of Experts. Reports include the required declaration of truth, a statement of the expert's independence, and a clear summary of the opinion expressed.

Experience Across Complex Cases

Prof. Hindocha has provided expert evidence across a range of clinical negligence, personal injury, and related proceedings involving complex medical issues. His ability to express nuanced clinical opinions in clear, plain language is particularly valued in cases where the evidence is genuinely disputed.

FREQUENTLY ASKED QUESTIONS

Common Questions About Expert Witness Instructions

Practical guidance for solicitors and legal teams.

Yes. Prof. Hindocha accepts instructions from both claimant and defendant legal teams, and can also be appointed as a single joint expert (SJE) where both parties agree. His duty in every case is to the court. The opinion expressed in his reports is formed independently and is not adjusted to suit the preferred position of either party.
A Single Joint Expert is an expert appointed jointly by both parties rather than each side instructing their own expert. Courts often order SJE appointments in cases where the medical issues are not fundamentally disputed, or in lower-value claims. SJE reports are addressed to both parties and the court simultaneously.
His expertise covers matters within plastic surgery and related surgical disciplines — including wound care, reconstructive procedures, burns, trauma, and scar assessment. He provides opinions on standard of care, causation, prognosis, and quantum in both clinical negligence and personal injury matters.
Yes. Every expert report produced by Prof. Hindocha complies with CPR Part 35 and the associated Practice Direction. Reports include the required declaration of independence, statement of truth, and confirm that the opinions expressed represent the expert's true and complete professional view.
Turnaround depends on the volume of material to review and the complexity of the issues. Prof. Hindocha's practice provides a realistic estimated timeline at the point of instruction.
