What Constitutes Medical Negligence?

Medical negligence occurs when a healthcare professional fails to provide the standard of care expected of a reasonably competent practitioner, and that failure causes harm to the patient. Not every poor outcome constitutes negligence — both breach of duty and causation must be established.

Expert witness evidence is essential in most medical negligence claims. The court requires independent clinical opinion to determine whether the standard of care was met and, if not, whether the breach caused or materially contributed to the harm suffered by the patient.

The expert’s overriding duty is to the court, not the instructing party. Prof. Hindocha’s opinions are formed independently and are not influenced by who instructs him, in accordance with CPR Part 35.
The Bolam test is applied — whether the practitioner acted in accordance with a responsible body of medical opinion. The Bolitho refinement may also be considered. Prof. Hindocha assesses whether this standard was met at the time of treatment.
Timescales depend on the volume of records and the complexity of the case. Prof. Hindocha aims to produce reports within an agreed timeframe confirmed at the point of instruction.
Prof. Hindocha accepts instructions from both claimant and defendant sides but not simultaneously in the same matter, in full compliance with his duty of impartiality.
CPR Part 35 sets out the procedural rules governing expert evidence in civil proceedings. All reports include a declaration of truth and comply fully with the accompanying Practice Direction.
